The association calls for an independent inquiry into the case of a minor deprived of his father

Published on By الجمعية المغربية للدفاع عن حقوق الأب والأبناءStatement

In the summer of 2025 the association issued three statements on a case it is following: a minor deprived of his father for more than two years despite enforceable judgments, and a complaint of suspected abuse dismissed without a medical examination. Our demands.

The Moroccan Association for the Defence of the Rights of Fathers and Children condemns in the strongest terms the sexual assaults and harassment suffered by children in our country, and sees in them the sign of a failure to protect children from exploitation. The association is following with deep concern the case of a minor whose father is accompanied by the association's board.

What the association has found

  • The dismissal of a complaint of suspected indecent assault without a forensic medical examination in the presence of the guardian, despite instructions to that effect; delaying the examination amounts to losing medical evidence and obstructing justice, while an official medical-psychological report confirms the child's statements to the doctor.
  • The forced handover of the child to the custodian despite his refusal and his tears, and despite the suspicion supported by a medical certificate.
  • The deprivation of the father of any bond since June 2023 — more than two years — despite enforceable judgments, despite the conviction of the other party for failure to hand over a child at every stage of the proceedings, and the concealment of the child from his father.
  • The enrolment of the child in a school without the knowledge of his legal guardian, then his removal from the school once the father found the address, in breach of legal guardianship.
  • The delay in handling eleven complaints forwarded by the Presidency of the Public Prosecution two years ago, despite the official support of our association and of the association "Matkich Weldi" and the assistance of the National Observatory for Children's Rights.

Our demands

The association calls for the opening of an urgent and independent inquiry, for everyone whose involvement or failure is established to be held accountable, for the principle of accountability to be applied, and for the child's best interests to be protected without discrimination. We have full confidence in our institutions — the Higher Council of the Judiciary and the Presidency of the Public Prosecution — and in their commitment to protecting minors and upholding the rule of law. The association will spare no effort, including national and international escalation on the human-rights front if necessary, until justice is done for this child and for the other children of Morocco. What this case shows, thousands of fathers live through: deprivation of the bond, non-enforcement of judgments, and disregard for the right of the father, as legal guardian, to enrol his children and watch over their physical and psychological health.
